Terms of Service

1. Acceptance of Terms

By accessing or using AppointmentSniper ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AppointmentSniper is an automated monitoring service that checks for Global Entry appointment availability and sends alerts when earlier appointments become available at your selected locations.

What We Provide:

• 24/7 monitoring of up to 3 Global Entry enrollment center locations
• Instant Telegram notifications when earlier appointments are found
• 60-day monitoring period per payment
• Ability to update your locations and appointment date

What We Do NOT Provide:

• We do not book appointments on your behalf
• We do not guarantee appointment availability
• We do not provide Global Entry application assistance
• We are not affiliated with U.S. Customs and Border Protection (CBP)

3. User Obligations

You agree to:

• Provide accurate email and Telegram information
• Have an active Telegram account to receive notifications
• Book appointments yourself when notified
• Comply with all CBP rules and regulations
• Use the Service for lawful purposes only
• Not attempt to circumvent, disable, or interfere with the Service
• Not resell or redistribute access to the Service

4. Payment and Pricing

4.1 Fees

The current price for 60 days of monitoring service is displayed on our website. Payment is processed securely through Stripe.

4.2 Non-Recurring Payment

AppointmentSniper is a one-time payment service, not a subscription. Your monitoring period lasts 60 days from account activation. There are no automatic renewals or recurring charges.

4.3 No Partial Refunds

Payments are non-refundable except as specified in our Money-Back Guarantee (Section 5). Early cancellation does not entitle you to a prorated refund.

5. 60-Day Money-Back Guarantee

5.1 Automatic Refund Eligibility

If we do not send you at least one appointment alert for a date/time earlier than your specified threshold date within your 60-day monitoring period, you are eligible for a full automatic refund.

5.2 Automatic Processing

Eligible refunds are processed automatically on Day 60. You do not need to request a refund. If eligible, we will:

• Issue a full refund to your original payment method
• Send you a Telegram notification confirming the refund
• Process the refund within 24 hours of eligibility determination

5.3 Refund Timeline

Refunds typically appear in your account within 5-10 business days, depending on your bank or card issuer.

5.4 Ineligibility for Refund

You are NOT eligible for a refund if:

• We sent you at least one appointment alert before your threshold date
• You booked an earlier appointment through our service
• You violated these Terms of Service
• You provided incorrect information (wrong date, wrong locations, etc.)

6. Service Availability

6.1 Uptime

We strive to maintain 24/7 service availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect service.

6.2 CBP Data Dependency

Our service depends on publicly available data from U.S. Customs and Border Protection. We are not responsible for CBP system outages, data inaccuracies, or changes to their appointment system.

6.3 Telegram Dependency

Notifications require an active Telegram account and internet connection. We are not responsible for Telegram service outages or delivery delays beyond our control.

7. Limitations of Liability

7.1 No Guarantee of Results

We do not guarantee that earlier appointments will become available during your monitoring period. Appointment availability depends entirely on CBP and other applicants' booking behavior.

7.2 Maximum Liability

Our total liability to you for any claims arising from the Service is limited to the amount you paid for the Service. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

7.3 Missed Appointments

We are not liable if you miss booking an appointment due to delayed notifications, Telegram delivery issues, or your unavailability when an alert is sent.

7.4 Third-Party Actions

We are not responsible for actions taken by CBP, Telegram, Stripe, or any other third party.

8. Account Management

8.1 Pausing Service

You may pause monitoring via Telegram commands. Pausing does not extend your 60-day period or entitle you to a refund.

8.2 Updating Information

You may update your monitored locations and threshold date at any time via Telegram commands.

8.3 Account Termination

We may terminate your access to the Service if you:

• Violate these Terms
• Abuse or attempt to manipulate the Service
• Engage in fraudulent payment activity
• Use the Service for unlawful purposes

9. Intellectual Property

All content, features, and functionality of the Service are owned by AppointmentSniper and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

11.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Government Affiliation

AppointmentSniper is not affiliated with, endorsed by, or connected to U.S. Customs and Border Protection, the Department of Homeland Security, or any government agency.

11.3 Appointment Accuracy

While we strive for accuracy, we do not guarantee that all available appointments will be detected or that detected appointments will still be available when you attempt to book them.

12. Indemnification

You agree to indemnify and hold harmless AppointmentSniper and its operators from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United States and the State of California.

13.2 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at support@appointmentsniper.com

13.3 Arbitration

Any disputes that cannot be resolved informally will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via Telegram notification and by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
